DILG can pursue admin cases vs Dasmarinas barangay captain and treasurer even if they quit

The Department of Interior and Local Government (DILG) on Friday said they can still pursue administrative charges against the barangay captain in Dasmariñas who was allegedly involved in a sex scandal with his treasurer even after he resigned.
Local Government Undersecretary and spokesperson Jonathan Malaya said they have yet to receive the resignation of the barangay captain.
“In any case, if he indeed resigned, we can still pursue admin charges against him but he can no longer be suspended or relieved but instead fine or disqualification from public office may be imposed against him,” Malaya said.
Malaya said resignation does not extinguish his administrative liability since the act was done while he was in office.
On Thursday Malaya said they ordered an investigation on the incident after an reported video of the sexual act went viral.
Meanwhile, Jorge Magno, president of the Association of Barangay Captains (ABC) in Dasmarinas, said the two officials who are both married have stepped down from their posts.
In a TV interview, Cavite Governor Jonvic Remulla said there is no need to probe the incident as both officials have resigned.
“What is there to investigate? What is there to prosecute? It was an act of two consenting adults although they were both married. There is nothing to investigate. They resigned,” Remulla said.
In his Facebook post, Remulla said the barangay captain of Fatima Dos in Dasmariñas, his female staff, and their respective families have processed the incident and have chosen to stay together and move on.
“Unfortunately, ‘moving on’ also means losing their jobs as well as their respective mandates,” he said.
“I will not defend their actions, they are inexcusable and ignorant. What I am asking for, is a little compassion. I am sure the families involved are wounded and hurting deeply… The humiliation alone is enough punishment for those involved,” he added. Ella Dionisio/DMS
