Former Vice President Binay to seek reinvestigation of case: spokesman

Former Vice President Jejomar Binay said he will ask the Ombudsman for a reinvestigation of a graft case which the government agency ordered to be filed against him, his son and other Makati officials.

In a statement by his spokesperson, it said: “The Ombudsman conducted a preliminary investigation against former Vp Binay during his term as Vice President despite a Constitutional prohibition. The agency did not bother to get his official reply even after his term as VP expired in July 2016. “

It said this is a “clear denial of due process and a violation of Constitutional rights.”

“The Ombudsman cannot claim to speak for rights and due process when she herself observes them selectively,” the statement said. Ombudsman Conchita Carpio Morales said Thursday she has ordered the filing of multiple counts of graft and falsification charges against Binay. and former Makati City Mayor Jejomar Erwin Binay, Jr. for conspiring to rig the procurement processes of the P1.3 billion Makati Science High School Building located along Kalayaan Avenue in Makati City.

In two separate resolutions approved on August 1, Morales indicted Binay with four counts of violation of Section 3(e) of the Anti-Graft and Corrupt Practices Act ( RA 3019) and three counts of falsification of public documents. Binay, Jr. is also set to face four counts of violation of Section 3(e) of RA No. 3019 and three counts of falsification. . The former vice president’s spokesperson “stress that the resolutions issued by the Ombudsman Thursday did not find any evidence of alleged overpricing in the construction of Makati Science High School. “

It said the “indictments merely found alleged violations in the bidding process. These allegations, however, have been answered extensively by former Mayor Junjun Binay but the Ombudsman chose to disregard them.” DMS
