Police waiting for Japanese rape victim to return to file charges vs Filipino

A Japanese national was allegedly sexually assaulted by a Filipino man she went bar hopping with in Mandaue City on August 14, but police said they are still waiting for the victim to return to the Philippines so charges can be pressed.

The victim, 29, was allegedly sexually assaulted by a 45-year-old suspect after having a drinking session with the suspect around 1:00 am, a police report said.

The victim and the suspect were drunk after they went bar hopping. The suspect brought the victim to Mandaue Hotel and performed the sexual assault, it said.

The victim reported the incident at 4:00 am to the police but refused to undergo genital examination due to her scheduled flight to Japan at 2:00 pm on August 15.

PO2 Edwin Camuta, investigator of the case from the Lapu-lapu City Police said in a text massage with the Daily Manila Shimbun, they are still waiting for the victim to go to the police station so an affidavit of complaint can be prepared.

Camuta said they need "some other pertinent documents, attachments in order to file appropriate charges" against the suspect who was released from police custody on August 15.

"The consulate from Japan coordinated with our office and they represent the victim while we prepare the affidavit for filing the case in court", he said.

"Suspect was released from police custody last August 15 after reaching reglamentary period of detention after the victim left the country and failed to return and file the case on the given prescription period of time", Camuta said.

The police report said the suspect started to undress the victim while inside the room in Mandaue hotel. The victim resisted and refused but he continued harassing her, it said.
