Makati court dismisses Trillanes’ appeal on rebellion case

Senator Antonio Trillanes IV lost his appeal on the decision of the Makati Regional Trial Court to appeal his rebellion case during the 2007 Manila Peninsula case.
In a six-page order on Monday, Judge Elmo Alameda of Makati RTC Branch 150 dismissed the motion for reconsideration filed by Trillanes for lack of merit and upheld his order for the senator's arrest and issuance of hold departure order.
The court said Trillanes failed to prove he has complied with the minimum requirements when he applied for amnesty during the Aquino administration.
"Sen. Trillanes failed to prove that the original of the alleged application form exists. Sen. Trillanes even failed to explain his failure to locate or find the copy thereof," stated the order, copy of which received by the Department of Justice.
The court pointed out Trillanes' failure to prove the contents of his application.
"Since the existence of the fact of his admission of guilty of the crime he committed, the substitutionary evidence presented by Sen. Trillanes is considered hearsay evidence and cannot be admitted as evidence to prove compliance with the minimum requirement set forth in Proclamation No. 75 (Amnesty Grant)," the court.
Makati RTC Branch 150 in September 2018 revived the criminal case against him following President Rodrigo Duterte's issuance of Proclamation 572 voiding his amnesty.
Trillanes posted bail amounting to P200,000 before the court and was granted temporary liberty. DMS
